The present website www.polynesiaparadise.com (hereinafter the “Website” or “Polynesia Paradise”) gives access to an information and travel portal dedicated to the Polynesian triangle (Hawaii, New Zealand, French Polynesia, and the islands and countries located between these three geographical points) offering informative content on these different destinations, and allowing to book and buy trips, stays and activities including tours, activities, car rentals, hotel nights and means of transportation.
These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) are intended to apply between the Site and any person wishing to access the Site and/or use the services offered from the Site (hereinafter, the “User” or “Customer”).
The use of this site, including simple browsing by the User, and the reservation of a product or service through its online store imply unreserved acceptance of these GTC, which the User acknowledges having read in full. The User affirms that he/she has the full legal capacity to commit to these general terms and conditions of sale.

The Site is published by Polynesia Paradise OÜ (hereinafter the “Company”), a private limited company with a capital of 2500€, whose address is located at Harju maakond, Kuusalu vald, Pudisoo küla, Männimäe/1, 74626, Estonia, registered in the Tartu Trade Register under the number 16472801 as a travel agency company
The Site is hosted by IONOS 1&1, a limited liability company with a share capital of €100,000, whose registered office is located at 7 place de la Gare, 57200 Sarreguemines, registered with the Sarreguemines Trade and Companies Register under number 431303775.
Use of the Site
Polynesia Paradise offers information on the different destinations of the Polynesian triangle, in a perspective of discovery and tourism. The Website is accessible free of charge to any User with an Internet connection. From the site, Users can access the following services
- Articles and information content
- Booking of services and tourist stays
- Page containing the orders and reservations made by the User
Limitation of liability
The information contained on the Site must be used with good intelligence and in no way engages the responsibility of the Site. The information, referenced addresses and other practical details are likely to change and to be updated regularly by the editorial team of the Site.
Terms and Conditions Relating to the Online Reservation of Services
Polynesia Paradise offers products and services related to tourism in the Polynesian triangle for reservation. These can be organized by the Company itself or in partnership with local companies (among others: tour-operators, hotels and accommodations, transport companies, car rental companies).
The confirmation of an order implies acceptance of these general conditions of sale, the recognition of having perfect knowledge of them and the renunciation to prevail itself of its own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction.
Reservation of services
When booking services, the User agrees to abide by these GTCs as well as any additional terms and conditions relating to the service booked. These conditions may include the terms of payment, pick-up by the provider at a specified location, respect of the schedules communicated for the organization of the service and any other terms allowing the provider to deliver the service under the conditions indicated and accepted by the User.
Confirmation of Availability
Upon making an online booking on the Website, the Company will have to first verify the availability of the service before receiving the payment. If the Customer ordered using Stripe or PayPal payment gateways, their payment will only be authorized by these platforms. The capture of the payment will happen once the availability of the service has been confirmed by the Company. If the Customer chose another means of payment, such as a bank transfer, they will have to wait for confirmation of availability before making said payment. This confirmation of availability will be communicated to them by email.
If the desired service is not available at the time chosen by the User, another slot or date will be offered to them, if any is available. If no other time can be found to organize the service for them, the payment made using Stripe or PayPal will not be captured. Similarly, the confirmation of availability will not the sent to the User if he chose to pay another means of payment, such as a bank transfer.
Deposit and Payment of the Remaining Balance
When booking a service, online payment may be requested either to pay for the entire service or as a deposit corresponding to a percentage of the total price of the booking to confirm the booking. The payment of the balance will have to be made under the conditions mentioned on the presentation page of the service, and specified later by email.
The balance must be paid in full before taking part in an activity booked online. In case of non-payment, the service provider may refuse to deliver the service and the cancellation conditions by the User will be applied. If a specific time-window was specified on the booking page of the said service for the settlement of their remaining balance, the Customer accepts to respect it and understands that if they don’t, the cancellation of the service will be considered as initiated by them.
Cancellation Conditions
This section covers the conditions under which a service booked on the Website may be cancelled, and the manner in which the amount paid at the time of booking will be returned to the customer or deducted to cover cancellation fees. Such cancellation may either be initiated by the Company or its partners (due to conditions that may include, but are not limited to, weather conditions or failure to reach a minimum number of participants), or by the Customer.
If the Company or any of the service providers it works with cancels a service, the User can either 1) reschedule their activity to a later time, 2) use the amount to book other activities on the Website thanks to a non-expiring coupon issued by the Company, 3) get a refund of the amount paid on the Website, minus a 5% fee if the said payment was made with Stripe or PayPal, to cover these two platforms non-refundable fees. This refund will be issued using the same method that the one chosen at the time of the Guest’s booking.
If the Customer decides to cancel his/her participation in the service they have booked, regardless of the reason for the cancellation, cancellation fees may apply. The cancellation fee for a reservation made on the Website is 15% of the total amount of the reservation. To these cancellation fees may be added those of the service providers, according to the conditions given on the reservation page or in the present general sales conditions for each service.
Special Cases Regarding Cancellation Conditions
In view of the cancellation fees mentioned above, the Customer is aware of the special conditions applied to the following products:
- Romantic Dinner in Bora Bora, Romantic cruise in Bora Bora – Sunset, Day Tour on Bora Bora Lagoon: Cancellation fee of 35% of the total amount applied in the event of cancellation by the customer for a tour starting in less than 30 days. A cancellation fee of 100% of the total amount applies in the event of cancellation by the customer for a tour starting in less than 7 days.
- Jet-Propelled Snorkeling Tour in Bora Bora, Romantic Dive in Bora Bora, Underwater Scooter Tour in Bora Bora, Half-Day Whale Watching in Bora Bora: Cancellation fee of 35% of the total amount applied in the event of cancellation by the customer for a tour starting in less than 30 days. A cancellation fee of 100% of the total amount applies in the event of cancellation by the customer for a tour starting in less than 7 days.
Rescheduling and Booking Modification
If the Customer asks for a rescheduling or a booking modification, the possibility to make such change is dependent on the availability of the service, and on the terms set by the provider of the service. If a service cannot be rescheduled and the Customer cannot participate at the time they initially booked it, this should be interpreted as a cancellation by the customer. Such rescheduling should be requested at least 7 days before the booked service.
Order and User Account
When placing an order, the User will obtain an account on the Site, created automatically. A username and password will be automatically created and communicated by email to the User. The User will then be able to access his/her account at www.polynesiaparadise.com/my-account where he/she will be able to retrieve his/her order information and modify his/her information.
